This Policy applies to all visitors and customers of our website, platform, social media sites, and app.

IV. INFORMATION WE COLLECT FROM CUSTOMERS

A. Personally-Identifiable Information.

Our Customer’s privacy is important to us. We collect Personally Identifiable Information for only legitimate business activities. The information collected from users may include: name, address, phone, and email address; which is necessary for our Company to conduct business. This information is retained and used to identify customers and visitors; respond to customer service inquiries; as well as advertising and marketing purposes. For visitors that reside in the E.U. or U.K., our Company will process your personal information in compliance with G.D.P.R.

(i) Web Server Log Information.

Our Company uses a third-party server to host our website called “Media Temple.” Their privacy policy can be accessed on their website by following this link: https://mediatemple.net/legal/privacy-policy/. This policy supplements our Company’s privacy policy. Our own personal server is located in the United States.

(ii) Web Server Log Information for I.T. Security Purposes.

Our Company does not access log data from our website server; Our third-party hosting provider collect(s) and store(s) server logs to ensure network and I.T. security and so that the server and website remain uncompromised. This includes and is not limited to: analyzing log files to help identify and prevent unauthorized access to our network; the distribution of malicious code; denial of service; and other cyber-attacks; by detecting unusual or suspicious activity.

(iii) Website Analytics.

Our Company uses Matomo.org to collect non-personally-identifying information that web-browsers and servers typically make available such as: browser type; language preference; referring site; as well as the date and time of each visitor request. B. COPPA and Sensitive Data.

Our Company does not knowingly collect any information regarding children nor do we collect sensitive personal information. We request that you do not send us any sensitive information or data regarding minor children.

(i) Personal and Non-Personal Identifiable Information.

When you send an email to the email address displayed on our website or use our contact form; we collect your email address and any other information you provide in that email (i.e. name; telephone number; and information contained in any signature block in your email).

(ii) Transfer and Storage of Your Information.

We use a third-party email provider to store emails sent to us by Customers. Our third-party email provider is “Media Temple” located in the United States. Their Privacy Policy supplements our policies and agreements, and it can be found by following their link: https://mediatemple.net/legal/privacy-policy/.

(iii) We Collect Personally Identifiable Information When You Sign Up for Our Newsletter.

When a Customer registers or signs up for our newsletter, their email address is added to the contact list of those customers who may receive email messages containing information of a commercial or promotional nature regarding our website. The Customer’s email address might also be added to this list as a result of signing up to this website.
These services and service providers make it possible to manage a database of email contacts to communicate with the User via email. Servicers and service providers collect data at the date and time when an email is viewed by the User, as well as when the Customer or User interacts with incoming mail, such as clicking links included within an email.

C. Information Sharing.

Information collected is used internally for marketing and advertising purposes. Your personal information is only accessed by our Company’s owners; employees; and staff. Visitors and customers can opt-out of information sharing by clicking the “unsubscribe” link found at the bottom of email messages. Please see sections III B. and IV C. to learn how to opt out of cookies and promotional emails.

(i) GetResponse (Implix Sp. z.o.o.)

GetResponse is an email address management and message sending service provided by Implix Sp. z.o.o. This service collects Personal Data such as: name and email address. The information provided or collected is processed in Poland. Their Privacy Policy can be accessed by following this link: https://www.getresponse.com/legal/privacy.html.

This servicer helps with building and managing landing and invitation pages, i.e. pages for presenting a product or service, where you may add your contact information such as an email address. Managing these pages means that these services will handle the Personal Data collected through the pages, including Usage Data.

(ii) Leadpages (Avenue 81, Inc.)

Leadpages is a landing page management service provided by Avenue 81, Inc., that allows the Application to collect email addresses of Users interested in its’ service.
Leadpages allows the website owner/developer to track and analyze the User’s response concerning web traffic or behavior regarding changes to the structure, text, or any other component of the created landing pages. Personal Data collected is: email address; Usage Data; and various types of Data as specified in the Privacy Policy of the service. All data is processed in the United States and their Privacy Policy can be viewed and accessed at: https://www.leadpages.net/privacy.

D. Privacy Policy Changes.

We may decide to change or modify our Privacy Policy at any time. When we amend our Privacy Policy, we will notify visitors and customers via policy change notices displayed on our website, with the effective date.

E. Information Retention.

Our Company retains User information for up to three (3) years after we first acquired your personally identifiable information.
At the end of this retention period, User records will be destroyed unless the User or Client still maintains an active account.
In all other instances, files will be permanently deleted from our system. After this Retention Period, the User or Client acknowledges we will be unable to answer inquiries or requests for information regarding the User or their account.

(i) Criteria for Determining Retention Periods.

Under normal circumstances, we will retain your information for no longer than necessary taking into account the following:

V. PERMISSION FOR PROMOTIONAL EMAILS

A. Sales and Special Offers.

When a customer or visitor sends us an email; completes a request for more information; or otherwise contacts our company; they give us permission to send them promotional email messages related to sales or special offers; responses to requests for more information; or customer support email messages.

B. How to Stop Promotional Emails.

Users can stop receiving promotional emails by clicking the “unsubscribe” link in the bottom of each email message. Upon receipt of the “unsubscribe” request, you will no longer receive promotional or marketing emails.

A. What is a Cookie?

Business partners may also use cookies to track customer’s viewing habits and send advertisements (i.e. Non-Personally Identifiable Information). Users understand and agree that our Company has no control over information business partners collect, including but not limited to information collected through cookies.

C. How to Opt-Out of Cookies.

Users and visitors can opt out of cookies at any time by changing their browser’s security settings although this may affect how they use, access and view websites.
CalOPPA. Alternately, if a User or Customer refuses cookies they can send a “Do Not Track” request to our Customer Service Department at: info@mediterraneanbook.com . Upon receipt of your “Do Not Track Request”, we will make sure any new personally-identifiable information collected about you will not be used for a targeted marketing campaign.

IX. HOW TO CHANGE YOUR PERSONAL INFORMATION

A. Information Requests.

Users can submit a request regarding personal information we retain on their account; or request a change to personal data on their account by: contacting our Data Control Officer and Owner via telephone; email; or mail correspondence. B. Identification.

Include all of your contact information with requests as well as a copy of your identification for verification purposes. Please allow up to thirty (30) calendar days for responses to requests and changes to account data.

X. ACCESSING THIRD PARTY LINKS

A. Third-Party websites.

Offers from our business partners are made available to visitors and customers through our website. Visitors may also discover links that allow them to click through our website to third-party sites.

Users acknowledge that these websites will have their own Terms and Privacy Policy Agreements, which each user should read for their own information. Users understand that our Company has no control over these websites, their policies, or how and when they collect personal information about you.

B. Limited Liability.

As a result, users agree to release our Company from any liability regarding any website they use or access, and our Company disclaims any and all liability or responsibility for the content on these websites. When users access or visit these websites, they acknowledge it is done at their own risk.

XI. COPPA

Our Company is COPPA complaint (Children’s Online Privacy Protection Act). Children under the age of eighteen (18) are prohibited from using or accessing our website without the consent of a legal guardian or parent. Our Company does not knowingly or willingly collect or retain any information or data regarding minor children.

XII. CALIFORNIA ONLINE PRIVACY PROTECTION ACT

Our Terms of Service and Privacy Policy comply with California’s Online Privacy Protection Act. Those terms have been implemented within our Privacy Policy. (BPR Div. 8, ch. 22, ss. 22575-22579).

XIII. GDPR POLICY FOR E.U. CUSTOMERS

A. Supplemental.

For Clients, Visitors, and Customer’s residing in the E.U. or U.K., our GDPR Policy supplements our U.S. Privacy Policy. Our company only collects information that is necessary for one or more of its legitimate business functions or activities.

B. Information Collection.

Personally-identifiable information collected includes and is not limited to: name; email address; phone number; and any information necessary for our company to perform its’ duties and obligations under our agreements and policies. This information is considered “personal data” as defined by Article 4(1) of the GDPR. We will never sell your personal information, although it may be shared with employees and affiliates when necessary to perform a legitimate business or fulfill our duties and obligations under our Terms of Service. Shared data will be disclosed in accordance with Articles 13 and 14 of the GDPR. Personal information collected will be processed in compliance with the GDPR.

XIV. CHANGES TO OUR PRIVACY POLICY

Our Company reserves the right to change, modify, or alter our Privacy Policy at any time. When changes are made to our Privacy Policy, notice shall be uploaded on our website along with its effective date.

XV. HOW WE HANDLE DISPUTES

Our Privacy Policy supplements our Terms of Service which contains a mandatory Mediation Clause, with Mediation taking place in Italy. Those provisions and conditions apply to disputes involving our Privacy Policy; Terms of Service; Service agreements and policies.

XVI. LAWS GOVERNING OUR POLICIES AND AGREEMENTS

If any provision of this Agreement is deemed unenforceable, or invalid, the unenforceable or invalid provision shall be deemed modified to the least extent necessary to become legal and enforceable and no other provisions affected thereby.
These Terms of Use shall be governed by and construed in accordance with the laws of the Italy, excluding conflicts of law or C.I.S.G. provisions.
